Current Practices in Corporate Video Production

In this essay i will be outlining and current practices within corporate video production, within any video published and advertised online there needs to be certain steps to make sure that everything is legal, ethical and not discriminatory.

Copyright is a contentious issue for clients and consumers of all corporate video, if any content may it be imagery, video or music is used it can cost loads and even lead to court. Every photo that is reproduced online is owned by someone and they have every right to protect their own work, even if you find the image on google images you can still run a risk of being in breach of copyright and could be sued by the owner.


Music is also a key note in terms of copyrighting issues for corporate video, it can be copyrighted the same way as images are as there is a lot of free music websites to browse copyright free songs etc. This can be an issue within corporate video as traditionally videos that would want to be more appealing would have a backing track or music of some sort, YouTube is a big factor in music the copyright protection has become more accurate in flagging and taking down videos that have used certain music without permission.


An example is from 2008, a Seattle design firm 'Modern Dog' utilized a series of sketches of dogs and published it in their book, the firm alleges that illustrations from that design have been used in a top produced by Target for sale and filed a lawsuit.


A famous music copyright breach is from Vanilla Ice and his song 'ice ice baby' it samples and didn't credit the song 'Under Pressure' by David Bowie and Queen, he finally fessed to sampling the work and it was settled privately out of court with Ice paying an undeclared sum of money and crediting them.

Privacy is a key factor to consider when making corporate videos, for example the court will likely favor someone's right to a private and family life against the media's right to freedom of expression. For example it will be relevant when filming about someones private and personal life and using information about their health or filming in their house or property without their permission. There can be expectations within privacy for example whether or not the person had a reasonable expectation of privacy in relation to the information like if they were asked permission to film them at a funeral and they signed it off as acceptable and then felt it was unacceptable after publishing.

An example of a famous privacy case in which the laws were breached is formula one boss Max Mosley who sued against News of the World after they had falsely accused him of taking part in a "sick Nazi orgy". They had invaded his privacy after they printed pictures and published video of him 'indulging in a five-hour sadomasochistic sex session with prostitutes in a Chelsea apartment' he failed in his bid to seek an unprecedented award of punitive exemplary damages but received £60k in damages.

Defamation is a law which allows individuals, companies or firms to sue for damaging their reputation whether it be by publishing materials in various forms and they can do so as long as the material can be reasonably understood to be referring to them. Something is classed as defamatory if it- causes them to be shunned or avoided, disparages them in their office, trade or profession, or exposes them to hatred ridicule or contempt.

An example is when Scarlet Johansson won damages over a French author whose novel featured a character resembling her, treated her as a sex object. He had to pay £2,000 for his "hurtful and demeaning" depiction of a female lookalike in his book, she sought out 50,000 euros in compensation after accusing Mr Delacourt of using her image to promote the novel. Her lawyer declared himself "extremely pleased" with the verdict, while Mr Delacourt's defense team called the compensation "derisory".

The fair use segment in video law makes it illegal for for creators to use certain clips or music in their videos unless it is under 'fair use'. It is basically any copying or copyrighted material done for a limited and "transformative" purpose such as to comment upon/review or parody. These things can be done without permission from the copyright owner, if your use for the materials can qualify as a fair use then it would not be considered an illegal infringement. Examples of fair use within corporate video could be when a certain type of corporate video impersonates or parody's another company..

Ethical issues are important when making videos as they can personally harm individuals, certain issues such as ensuring no one featured in the video is harassed assaulted or caused harm, respecting privacy, plagiarizing, respecting others rights of publicity. Ethics can also come up whilst filming videos such as not damaging or disrupting the environment or wildlife whilst filming. Whilst filming for our James Paget video we had to take notice of these issues especially with filming in a hospital ethical issues were very important, we couldn't film any patients at all due to privacy issues.

Releases within corporate video include things such as talent releases, risk assessments, location releases and recce's. These are all done during re-production when planning for the shoot, talent releases are forms used to protect anyone featured in the video so they are given a form which they have to date and sign giving permission to be featured in the video. Other release material such as a risk assessment are done to help anyone involved safety wise, giving pre warning and resolving certain dangerous issues. 

When making corporate video things such as camera and other technical equipment used are important to ensure that the quality of everything is up to scratch. An example of a camera used can be the Sony A7S you can get HD or 4K quality video, you can also use interchangeable lenses to get more out of your camera body only it sells for around £1,799.00 there are various other similar DSLR models such as the Canon 5D's etc but won't have the more professional finished look.  
An example of a brand and make of sound recording equipment would be  RĂ˜DE they are a popular brand that make microphones and sound equipment for cameras, the 'Rode Videomic Go On-camera Microphone' is the cheapest of their range for £57 it states to offer clear, crisp, directional audio with incredible ease of use. When it comes to filming lighting is a key aspect otherwise the whole thing can be ruined. An example of a brand and make of lighting  equipment would be Soft Box lights, they state they have continuous lighting, lightweight, fully adjustable and portable for only £57 for two 50x70cm ones is a reasonable price for a long lived high quality product. For higher quality bigger productions some companies that make corporate video could use a drone for aeriel and big establishing shots they can start off at around £70 for average quality but for HD footage the pricing will be around £449.95 for the DJI Phantom 3 which offers a 2.7k camera quality.
